Welcome to Everywhere (accessible via everywhere.best). These Terms of Service ("Terms") represent a legally binding agreement between you ("User" or "you") and Fly Media LLC ("we", "us", or "our"), governing your access to and use of our mobile applications, static website pages, API worker pipelines, and subscription-based distribution software.
1. Acceptance of Terms
By downloading our mobile app, establishing an account, connecting platform channels, or utilizing our syndication platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you are prohibited from accessing or using our services.
2. Channel Connectivity & Account Integrity
Everywhere facilitates the posting of vertical video content to third-party social media platforms.
- Account Authorization: You must connect your channels via our official OAuth authorization procedures. You represent and warrant that you own or have full legal authority to publish content to the channels you link.
- No Credentials Access: Everywhere does not store or ask for your primary account passwords. You are solely responsible for maintaining the privacy of your own account authorizations and connected third-party API configurations.
3. Acceptable Use Policies
You are solely responsible for all video files, descriptions, titles, metadata, and communications published using Everywhere. You agree that you will not upload or cross-post content that:
- Infringes upon any third-party copyrights, trademarks, or proprietary rights.
- Contains illegal material, malicious software, viruses, or code designed to interfere with system stability.
- Violates the community guidelines, publishing standards, or terms of service of TikTok, YouTube, or Instagram (Meta).
4. Subscriptions, Fees, & Apple In-App Purchases
Some features are premium and require active paid subscriptions (the "Creator Plan" or "Pro Plan").
- Apple Billing: For mobile users, billing is handled natively through Apple in-app purchases and subscriptions. Apple processes all card details, currency conversions, renewals, and billing notifications.
- Cancellation: You may cancel your subscription at any time directly within your Apple ID Account Settings. Your subscription benefits will remain active until the end of the current billing cycle.
- Refunds: Refund requests are managed exclusively by Apple according to their App Store policies. Fly Media LLC cannot directly process, override, or issue refunds for transactions handled through the iOS App Store.
5. Limitation of Liability
CRITICAL DISCLAIMER FOR CREATORS: To the maximum extent permitted by applicable law, in no event shall Fly Media LLC, its officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, reputation, or other intangible losses, arising out of or relating to:
- Any account restrictions, warnings, temporary shadowbans, or permanent suspensions issued to your social accounts by TikTok, Instagram, Meta, Google, or YouTube.
- The failure or delay of third-party platform API networks to process or display video files.
- Any content moderation flags, copyright claims, or sound-muting issues occurring on destination platforms.
6. Independent Social Syndication Platform
Everywhere is a tool built entirely independently by Fly Media LLC. All platform APIs utilized are officially made available by their respective providers. Everywhere is in no way officially endorsed by, affiliated with, or partnered with TikTok, Meta Platforms, YouTube, Google, or their subsidiaries.
7. Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida.
8. Modifications to Services and Terms
We reserve the right, at our sole discretion, to modify or discontinue any part of our services, or update these Terms, at any time to align with regulatory adjustments or third-party API changes. We will notify you of any material changes by updating the "Last Updated" date at the top of this page.
